2.3 Verification Requirement

3.3 No Warranty

We make no warranty, express or implied, regarding the Platform's fitness for any particular purpose, merchantability, or non-infringement. We do not warrant that the Platform will meet your requirements or that it will be available continuously without interruption or error.

3.4 Consumer Protection Act

Nothing in these terms is intended to limit any rights you may have under the Consumer Protection Act 68 of 2008 or any other applicable South African legislation that cannot lawfully be excluded.

By using this Platform, and in particular by interacting with the AI assistant, you consent to the following data processing activities as described in this notice.

5.1 Consent to AI Processing

When you submit a message or query to the AI assistant embedded on this Platform, you consent to:

• Your input being transmitted to and processed by AI systems to generate a response.
• Your conversation being logged internally for quality assurance and lead management purposes.
• AI-generated responses being returned to you based on the content of your query.

5.2 Third-Party AI Infrastructure

AI responses are generated with the assistance of third-party AI platform providers. Your query inputs may be processed by these providers' systems in accordance with their own terms of service and privacy policies. We take reasonable steps to ensure that such providers maintain appropriate data handling standards.

5.3 Purpose Limitation

Data submitted through the AI assistant is used exclusively to:

The content published on this Platform, including all AI-generated responses, product information, application guidance, financial commentary, and technical descriptions, is provided for general information purposes only.

6.1 Specific Exclusions

• Legal Advice: No content on this Platform should be interpreted as legal guidance on contracts, liability, regulatory compliance, or any other legal matter. Consult a qualified legal practitioner.
• Financial Advice: No content constitutes advice on investment, financing, asset acquisition, or financial planning. Consult a qualified financial services provider registered with the Financial Sector Conduct Authority (FSCA).
• Engineering and Safety Advice: Technical specifications are provided for general information purposes. Suitability of equipment for specific applications must be assessed by a qualified engineer or competent person. This is particularly important in regulated environments such as mines governed by the Mine Health and Safety Act (MHSA).

Section 7 — Governing Law & Jurisdiction

7.1 Applicable Law

These Terms of Use, Disclaimer, and Privacy Notice are governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions.

7.2 Jurisdiction

Any dispute arising from or in connection with your use of this Platform, or from any content or AI-generated output obtained through it, shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.

7.3 Dispute Resolution

We encourage users to contact us directly in the first instance to resolve any concern or dispute informally and in good faith. Where informal resolution is not achievable, disputes will be referred to the applicable South African court of competent jurisdiction.

7.4 Relevant Legislation

This Platform operates in compliance with, and these terms are to be read alongside, the following South African legislation (as amended from time to time):

• Electronic Communications and Transactions Act 25 of 2002 (ECTA)

These terms, together with any additional terms specific to particular services offered on this Platform, constitute the entire agreement between you and World Focus 1724CC in relation to your use of this Platform.
